2017 Proposed Permanent Rules

Oklahoma State Department of Education (OSDE) administrative rules are published in Title 210 of the Oklahoma Administrative Code.

Agency rulemaking is governed by the Oklahoma Administrative Procedures Act (APA) at 75 O.S. § 250 et seq.  Notice documents required by the Oklahoma Administrative Procedures Act are published in the Oklahoma Register by the Oklahoma Secretary of State's Office of Administrative Rules (OAR).  Informational materials on the APA rulemaking process are available at the OAR website.  The public is invited to submit comments on proposed permanent rules during the open public comment periods via email at rules@sde.ok.gov.  The APA does not require a public comment period for emergency rules prior to adoption, but when possible the agency provides an opportunity for public comment on proposed emergency rules. 

After close of the public comment period, proposed permanent rules are submitted to the State Board of Education for adoption.  Proposed permanent rules which have been adopted by the Board are submitted to the Legislature and Governor for review in accordance with the requirements of the Administrative Procedures Act.

RULES CURRENTLY OPEN FOR PUBLIC COMMENT

The State Department of Education invites public comment on the following proposed rule changes.  Written comments will be accepted until 4:30 p.m. on Monday, October 17, 2016.  To submit a written comment, please send via email to rules@sde.ok.gov or fax to (405) 521-6256.  You may also send written comments via postal mail to: Administrative Rules Liaison, Room 1-17, 2500 N. Lincoln Blvd., Oklahoma City, OK 73105 (please note--if you submit comments by postal mail, please send in time for delivery by October 17 in order for your comment to be included in the administrative record).

If you wish to submit an oral comment rather than a written comment, you must attend the public hearing.  The public hearing for these proposed rules is scheduled for 2:00 p.m. on Monday, October 17, at the Oliver Hodge Education Building, State Board Room (Room 1-20), 2500 North Lincoln Boulevard, in the State Capitol Complex in Oklahoma City.  Persons wishing to speak must sign in at the door of the State Board Room prior to the start of the hearing.  Time limitations may be imposed on oral presentations to ensure that all persons who desire to make oral comments will have an opportunity to do so.
