EMERGENCY RULES IN EFFECT

The State Board of Education adopted the following emergency rule on September 28, 2023. This emergency rule took effect October 5, 2023 upon the Governor's approval.

The State Board of Education adopted the following emergency rule on May 25, 2023. This emergency rule took effect June 8, 2023 upon the Governor's approval.

Pending Rule Changes and Statuses

Oklahoma State Department of Education (OSDE) administrative rules are published in Title 210 of the Oklahoma Administrative Code.

Agency rulemaking is governed by the Oklahoma Administrative Procedures Act (APA) at 75 O.S. § 250 et seq. Notice documents required by the Oklahoma Administrative Procedures Act are published in the Oklahoma Register by the Oklahoma Secretary of State's Office of Administrative Rules (OAR). Informational materials on the APA rulemaking process are available at the OAR website. The public is invited to submit comments on proposed permanent rules during the open public comment periods via email at rules@sde.ok.gov. The APA does not require a public comment period for emergency rules prior to adoption, but when possible the agency provides an opportunity for public comment on proposed emergency rules.

After the close of the public comment period, proposed permanent rules are submitted to the State Board of Education for adoption. Proposed permanent rules which have been adopted by the Board are submitted to the Legislature and Governor for review in accordance with the requirements of the Administrative Procedures Act.

The written public comment period will close at 4:30 p.m. on the day of their public hearing date listed below. Written comments may be submitted by email to rules@sde.ok.gov. A public hearing will be held for the following rules prior to consideration for adoption by the State Board of Education. The time and location of the hearing is detailed below. Anyone wishing to speak must sign in at the door of the State Board Room prior to the start of the hearing. Time limitations may be imposed on oral presentations to ensure that all who desire to make oral comments will have an opportunity to do so.

If approved by the State Board, the rule changes will then be submitted to the Oklahoma Legislature for review during the 2024 legislative session. Administrative rule changes must be approved by the Legislature or the Governor to go into effect.
