Open Records Act Request


Open Records Act requests for records from the State Board of Education or the State Department of Education (OSDE) may be made using the following form. Open Records Act requests are processed in accordance with the provisions of the Open Records Act and accompanying State Department of Education rule at 210:1-3-11.
 
Records that are not maintained by OSDE:
 
In order to provide prompt, reasonable access to records, to ensure that records requests are accurately communicated to the records custodian, and to enable the records custodian to accurately process the request, it is recommended that records requests be submitted by using the online Open Records Request (ORR) form below. The Open Records Request PDF is also provided which may be submitted online by email, fax, or regular mail via the return information stated on the form.
 
In accordance to the Oklahoma Open Records Act 51 O.S. § 24A.5, OSDE reserves the right to recover the actual cost of record search and copying, including labor, if the information requested is not readily available or requires an extended amount of time to retrieve. If you submit a request that is subject to additional recovery cost, you will be provided with an estimate before work begins.
 
Fee Schedule:
    a. $0.25 per page for photocopies of records up to 8 ½” x 14” or smaller.
    b. $1.00 per page for certified copies.
    c. Copies of other media (e.g. CD-ROM, flash drive, etc.) shall be actual cost of reproduction including labor.
 
Search Fees:
    a. $25 per hour search fee for commercial requests or those that cause excessive disruption of office functions. (OSDE defines an "excessive disruption" request as one that requires more than eight [8] hours of actual employee work time to compile)
    b. $80 per hour cost of labor fee when computer programming is required on a customized request (fee is set by Office of Maganement and Enterprise Services)
    c. $85 per hour when additional legal support is required (fee is the rate charged to state agencies for legal support by the Office of the Attorney General)

Record requests are processed in the order they are received and fulfilled within an average of approximately thirty (30) days. However, reasonable response times may be shorter or longer, depending upon a number of factors, e.g., the volume of pending requests; whether records responsive to the request are available in electronic format that can be searched; workloads of the department/area/division where the documents are maintained; time necessary to conduct a search for responsive records; scope and complexity of the request; number of documents identified as responsive to the request and time necessary to screen responsive documents to prevent disclosure of data deemed confidential under state and/or federal law.
